Following Owens’ opening statement, the judge recessed court for an hour for a lunch break.
He noted that both parties have agreed to split the cost of the meal for the jurors.
Gwyneth Paltrow, her husband Brad Falchuk and children Apple, 18, and Moses, 16, are set to testify during her 2016 ski crash trial, her lawyer said in court on Tuesday.
During his opening argument, Stephen Owens said all three would take to the stand and said Paltrow was left ‘freaked out’ by the crash that allegedly left optometrist Terry Sanderson, 72, with a permanent brain injury.
In his $300,000 lawsuit, Terry Sanderson claims he suffered a ‘brain injury, four broken ribs and other serious injuries’ after Paltrow struck him from behind on the Bandana Run at Deer Valley Resort on Flagstaff Mountain.
He claims Paltrow knocked him down, and he suffered ‘pain, suffering loss of enjoyment of life, emotional distress and disfigurement.’
In response, Paltrow filed a counterclaim saying Sanderson admitted he did not remember what happened, and according to her recollection, Sanderson plowed into her from behind, causing her to sustain a ‘full body blow.’
She said that when she expressed her anger to Sanderson, he apologized.
Gwyneth Paltrow’s defense attorney on Tuesday denied that Terry Sanderson’s forgetfulness is due to a brain injury he sustained in a 2016 ski accident.
‘It’s a normal problem,’ he argued, citing the plaintiff’s age and previous health issues.
In his opening statements Tuesday, Lawrence Buhler said he estimates the damages to Terry Sanderson from the ski accident to be over $3million.
‘At the end of the trial, the evidence will have clearly and convincingly established that the value —not the cost — but the value of the damages done to Terry Sanderson is $3,276,000,’ he said.
‘We look forward to showing you all of the evidence.’

Gwyneth Paltrow arrives in court for first day of $300,000 civil trial
Gwyneth Paltrow, 50, was seen stepping out of a black SUV and bundled up in a long coat, shades and $1,200 Celine lace-up boots, keeping her head down as she walked into Park City District Court on Tuesday.
Dr. Terry Sanderson, 76, who was seen entering court today with a face mask on, sued the Oscar-winning actress in January 2019 and alleged she crashed into the back of him and abandoned the scene at the exclusive Deer Valley resort in February 2016.
While waiting for the jury to file in, Paltrow, who has insisted that it was Sanderson who skied into her and that he was the uphill skier in the crash, sat quietly facing Judge Kent Holmberg’s seat and conferred briefly with her legal team.
